Affray

You commit the offence of affray contrary to Section 3 of the Public Order Act 1986, if you use or threaten to use unlawful violence towards another such that the conduct would cause a person of reasonable firmness present at the scene to fear for his/her personal safety.

It must be noted that there has to be two or more persons using or threatening violence, person of reasonable firmness need not actually be present at the scene, there must be evidence that anyone watching would have been put in fear for themselves. Affray can be committed in a public place or a private place.

Affray is an either way offence carrying the maximum sentence of 3 years imprisonment and an unlimited fine.
