Assault

The most common charges you are likely to face as an assault are:-

  1. Wounding with intent to cause grievous bodily harm (GBH with intent) contrary to Section 18 of the Offences Against the Person Act 1861. This is an indictable only offence carrying the maximum sentence of life imprisonment.
  2. Unlawfully and maliciously inflicting grievous bodily harm (GBH) contrary to Section 20 of the Offences Against the Person Act 1861. This is is an either way offence carrying the maximum sentence of imprisonment not exceeding 5 years.
  3. Assault occasioning actual bodily harm (ABH) contrary to Section 47 of the Offences Against the Person Act 1861. This is an either way offence carrying the maximum sentence of imprisonment not exceeding 5 years.
  4. d) Common assault contrary to Section 39 of the Criminal Justice Act 1988. Common assault is committed when you intentionally or recklessly cause a victim to apprehend immediate unlawful force or use of such force. There is no need for injury to have been sustained.
  5. It must be stressed that if any of the assaults are racially / religiously aggravated then the sentence is increased appropriately in accordance with the guidelines.
