Dwelling-House Burglary
You are guilty of this offence when:-
Entering a dwelling-house (or part of a dwelling-house) as a trespasser with intent to steal therein (or with intent to do unlawful damage)
OR
Having entered a dwelling-house (or part of a dwelling-house) as a trespasser stole (or attempted to steal)
It must be stressed that although dwelling-house burglary is an either-way offence, it becomes an indictable only offence if the third strike rule applies to you or anyone you are jointly charged with.
Burglary other than in a dwelling
You are guilty of this offence when:-
Entering a building (or part of a building) as a trespasser with intent to steal therein (or with intent to do unlawful damage)
OR
Having entered a building (or part of a building) as a trespasser stole (or attempted to steal)
